Bodywork.Exchange Terms of Service

Effective Date: June 6, 2006

Welcome to Bodywork.Exchange. These Terms of Service govern your access to and use of Bodywork.Exchange, including the website, member profiles, messaging tools, search tools, community features, supporter features, and related services.

By creating an account, checking “I agree,” accessing the site, uploading content, sending messages, or otherwise using Bodywork.Exchange, you agree to these Terms. If you do not agree, do not use Bodywork.Exchange.

These Terms work together with our Privacy Policy, Community Standards, Safety Guidelines, and any additional rules or notices posted on the site.

1. About Bodywork.Exchange

Bodywork.Exchange is an adult member community designed to help people connect around massage exchange, bodywork practice, respectful touch, learning, and community connection.

Bodywork.Exchange is not a medical provider, massage provider, massage school, licensing board, therapy provider, mental health service, dating service, hookup site, escort service, adult-content platform, or emergency service.

We do not provide massage, bodywork, medical advice, therapy, safety supervision, background checks, identity verification, professional credential verification, or in-person meeting supervision.

Members are responsible for their own profiles, messages, conduct, boundaries, decisions, and in-person meetings.

2. Eligibility

You must be at least 18 years old to use Bodywork.Exchange. If the legal age of majority or age of consent in your location is higher than 18, you must meet that higher age requirement.

By using Bodywork.Exchange, you represent and warrant that:

• You are at least 18 years old.
• You are legally permitted to use the site.
• You are not prohibited from using the site by law.
• You will provide accurate account information.
• You will use the site only for lawful purposes.
• You will comply with these Terms and our Community Standards.

We may suspend, restrict, or delete an account if we believe the member may be underage, using false information, violating these Terms, or creating risk for the community.

3. Account Approval and Moderation

Bodywork.Exchange may manually review profiles, photos, profile text, messages, reports, login information, IP information, activity patterns, and other information for community safety, fraud prevention, abuse prevention, policy enforcement, and site operation.

Approval of a profile does not mean that Bodywork.Exchange has verified a member’s identity, background, training, experience, skill, intentions, health status, legal status, safety, or suitability.

We reserve the right, at our sole discretion, to:

• Approve, reject, suspend, restrict, hide, or delete any account.
• Remove or edit profile content, photos, messages, or other content.
• Require profile changes before approval.
• Monitor accounts that appear unusual, incomplete, suspicious, unsafe, or inconsistent with the purpose of the site.
• Limit, block, or remove accounts that violate these Terms or Community Standards.
• Block repeat registration attempts by suspended or banned members.
• Preserve moderation records when reasonably needed for safety, fraud prevention, legal compliance, dispute handling, or protection of the community.

We are not obligated to monitor all content, messages, accounts, or activity, and we do not guarantee that we will detect every violation.

4. Member Responsibility

You are solely responsible for your use of Bodywork.Exchange and for any interaction you have with other members, whether online or offline.

You agree to:

• Treat other members with respect.
• Communicate clearly and honestly.
• Respect boundaries and consent.
• Stop contact if someone says no, does not respond, blocks you, or asks you to stop.
• Use good judgment before meeting anyone in person.
• Leave any interaction or meeting that feels unsafe, pressured, inappropriate, or uncomfortable.
• Follow all applicable laws.

You understand that Bodywork.Exchange does not supervise, control, or guarantee member interactions or in-person meetings.

5. Offline Meetings and Personal Safety

Bodywork.Exchange helps adults connect online, but any in-person meeting is arranged solely by the members involved.

We do not:

• Supervise in-person meetings.
• Guarantee that any member is safe, honest, skilled, trained, licensed, insured, healthy, or suitable.
• Verify professional credentials.
• Conduct background checks.
• Provide medical, legal, or safety advice.
• Accept responsibility for what happens between members offline.

Before meeting another member, you should communicate clearly, discuss boundaries, choose a safe setting, trust your judgment, and decline or leave any situation that does not feel right.

Any massage, bodywork, touch, practice session, paid session, trade, meeting, or other interaction between members is entirely the responsibility of the members involved.

6. Consent and Boundaries

Consent is required for all touch, communication, massage, bodywork, practice, meetings, and interactions connected to Bodywork.Exchange.

You agree that:

• Consent must be voluntary, specific, informed, and ongoing.
• A person may change their mind at any time.
• Silence, non-response, prior contact, prior meetings, or prior massage exchange does not mean consent.
• Pressure, guilt, threats, repeated requests, manipulation, intoxication, or coercion are not consent.
• You must immediately stop any communication, touch, or activity when asked.

Violation of this section may result in immediate suspension, removal, or banning.

7. Mature Member Content

Bodywork.Exchange is intended for adults only. Some member-uploaded content may include mature themes, body-focused photos, shirtless images, swimwear images, underwear images, or suggestive material.

By using the site, you acknowledge that you may encounter member-uploaded content that is mature, body-focused, suggestive, or otherwise not suitable for minors.

However, Bodywork.Exchange is not intended for pornography, explicit sexual content, sexual solicitation, escorting, prostitution, illegal massage, or illegal sexual activity. Content that crosses that line may be removed and may result in account suspension or termination.

We may remove any content we believe is too explicit, too sexualized, misleading, unsafe, illegal, commercially promotional, inconsistent with the purpose of the site, or likely to harm the community.

8. Content Standards

Members may upload profile text, photos, messages, and other content where allowed by the site.

All member content must be lawful, respectful, and consistent with the purpose of Bodywork.Exchange.

Bodywork.Exchange may allow tasteful body-related profile content when it is appropriate to massage, bodywork, fitness, wellness, or personal presentation. For example, a shirtless photo, swimwear photo, underwear photo, or tasteful body photo may be allowed if it is not explicit, threatening, exploitative, commercial, or sexually soliciting.

Bodywork.Exchange may remove any content at any time, with or without notice, if we believe it violates these Terms, violates our Community Standards, creates risk, or is not appropriate for the site.

9. Prohibited Content

You may not upload, post, send, publish, display, or distribute content that:

• Depicts, references, involves, or attempts to involve anyone under 18 in any sexual, suggestive, nude, exploitative, or adult context.
• Contains child sexual abuse material or any content involving minors in a sexual or suggestive way.
• Is sexually explicit, pornographic, or primarily intended for sexual arousal.
• Shows exposed genitals, explicit nudity, sexual acts, or close-up sexualized body parts.
• Solicits sex, sexual services, prostitution, escorting, happy endings, or illegal activity.
• Uses massage, bodywork, trade, touch, donation, honorarium, or similar language as code for sexual services.
• Harasses, threatens, bullies, intimidates, stalks, abuses, or exploits another person.
• Promotes hate, violence, discrimination, or bigotry.
• Is false, deceptive, fraudulent, spammy, or misleading.
• Impersonates another person.
• Contains private information about another person without permission.
• Infringes copyright, trademark, privacy, publicity, or other rights.
• Advertises commercial products or services without our prior permission.
• Attempts to collect passwords, financial information, identity documents, or sensitive personal information from other members.
• Contains malware, harmful code, scraping tools, bots, or automated access methods.
• Is otherwise illegal or inconsistent with these Terms or our Community Standards.

We may remove content even if it is not specifically listed above if we believe it is inappropriate for Bodywork.Exchange.

10. Photo and Image Rules

You may upload only photos and images that you have the right to use.

By uploading a photo or image, you represent and warrant that:

• You are the person shown in the image, or you have permission from every identifiable person in the image.
• Everyone shown in the image is at least 18 years old.
• The image does not violate these Terms, the Community Standards, or applicable law.
• The image does not infringe anyone else’s copyright, privacy rights, publicity rights, or other rights.
• You have the legal right to upload and display the image on Bodywork.Exchange.

We may require proof of permission, age, ownership, or identity where appropriate. We may remove any image at any time.

11. No Minors

Bodywork.Exchange is strictly for adults.

You may not:

• Create an account if you are under 18.
• Communicate with or attempt to communicate with anyone under 18 through the site.
• Upload content showing a minor in a sexual, suggestive, nude, mature, or adult context.
• Use the site to contact, solicit, exploit, groom, endanger, or interact inappropriately with a minor.

Violations involving minors may be reported to law enforcement or other appropriate authorities.

12. No Sexual Services, Escorting, or Illegal Activity

Bodywork.Exchange is not a platform for sexual services, escorting, prostitution, illegal massage, or coded sexual solicitation.

You may not use the site to offer, request, arrange, promote, imply, or negotiate:

• Sexual services.
• Paid sexual activity.
• Escort services.
• Prostitution.
• Happy endings.
• Illegal massage services.
• Commercial sexual activity.
• Any unlawful conduct.

References to massage, bodywork, touch, trade, donation, honorarium, or professional services may not be used to disguise sexual solicitation.

13. Commercial Use and Professional Services

Bodywork.Exchange is primarily for personal, community, and non-commercial use.

Members may not advertise, solicit, sell, recruit, or promote commercial products or services without our prior permission.

If Bodywork.Exchange allows any professional therapist, bodyworker, teacher, event organizer, or service provider to list services, that person is solely responsible for complying with all applicable laws, licensing rules, tax obligations, insurance requirements, advertising rules, professional standards, and client-safety requirements.

Bodywork.Exchange does not verify professional licenses, training, insurance, qualifications, or legality of services unless we expressly state otherwise in writing.

14. User Content License

You retain ownership of the content you upload or post.

By uploading, posting, or submitting content to Bodywork.Exchange, you grant Bodywork.Exchange a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, transmit, and use that content as reasonably necessary to operate, promote, moderate, secure, and improve the site.

This license ends when your content is deleted from the site, except that we may retain copies as reasonably necessary for backups, legal compliance, moderation records, dispute resolution, security, fraud prevention, or enforcement of these Terms.

You are responsible for your content and for any consequences of posting it.

15. Messages and Communications

Bodywork.Exchange may provide messaging or communication tools.

You agree not to use messages to harass, threaten, pressure, spam, scam, sexually solicit, advertise without permission, or violate another member’s boundaries.

We may review messages or message metadata when reasonably needed for safety, moderation, fraud prevention, abuse reports, legal compliance, or site operation. We are not required to review all messages and do not guarantee that messages are private from moderation review.

16. Reports and Complaints

Members are encouraged to report profiles, messages, photos, or behavior that may violate these Terms or Community Standards.

We may investigate reports in any manner we consider appropriate. We may take action, decline to take action, or request more information. We do not guarantee any particular outcome.

Reports should be made honestly. False, malicious, or abusive reports may result in account action.

17. Supporters, Payments, Subscriptions, and Refunds

Bodywork.Exchange may offer supporter status, subscriptions, donations, paid features, or other optional payments.

Payment terms, pricing, renewal periods, cancellation methods, and benefits will be disclosed at the time of purchase or on the relevant payment page.

Unless otherwise stated, supporter payments and subscriptions are non-refundable after purchase. We may, at our discretion, offer refunds for first-time purchases requested within 48 hours.

You are responsible for canceling any recurring payment before the next billing date if you do not want to renew. If you need help canceling, contact us at massageclub@bodywork.exchange.

Payments may be processed by third-party payment processors. Bodywork.Exchange is not responsible for the acts, omissions, security, policies, fees, or processing times of third-party payment processors.

18. Privacy

Our collection, use, retention, sharing, and protection of personal information is described in our Privacy Policy.

By using Bodywork.Exchange, you understand that we may collect information such as your account information, profile content, photos, messages, IP address, device/browser information, login activity, analytics data, payment-related information, reports, and moderation notes.

You agree that we may use this information to operate the site, provide services, process payments, communicate with you, review accounts, moderate content, enforce rules, prevent fraud, protect safety, improve the platform, comply with law, and protect Bodywork.Exchange and its members.

19. Site Availability and Data Loss

We try to keep Bodywork.Exchange available and functioning, but we do not guarantee uptime, uninterrupted access, error-free operation, or preservation of all data.

We are not responsible for losses caused by downtime, technical issues, data corruption, account restrictions, deleted content, lost messages, software errors, hosting problems, third-party services, or other interruptions.

You should keep your own copy of any profile text, photos, messages, or information that is important to you.

20. Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree not to:

• Share your password.
• Allow another person to use your account.
• Access another member’s account.
• Attempt to bypass security measures.
• Scrape, crawl, copy, harvest, or systematically collect member data.
• Use bots, automation, scripts, or unauthorized tools.
• Interfere with the site’s operation.
• Reverse engineer or attempt to access source code, databases, private systems, or restricted areas.

Notify us promptly if you believe your account has been compromised.

21. Third-Party Links and Services

Bodywork.Exchange may contain links to third-party websites, payment processors, analytics providers, email services, social media platforms, forms, event tools, or other services.

We do not control and are not responsible for third-party services, websites, content, policies, security, fees, actions, or failures. Your use of third-party services is at your own risk and may be governed by their own terms and privacy policies.

22. Copyright and Intellectual Property

The Bodywork.Exchange name, design, text, graphics, logos, site structure, features, software, and other materials are owned by Bodywork.Exchange or its licensors and are protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, scrape, or create derivative works from the site or its content except as allowed by these Terms or with our written permission.

If you believe content on Bodywork.Exchange infringes your copyright, contact us at massageclub@bodywork.exchange with enough information for us to identify the content and review your claim.

We may remove allegedly infringing content and may terminate repeat infringers. Bodywork.Exchange may adopt a more formal DMCA policy and designate a DMCA agent.

23. Termination

We may suspend, restrict, or terminate your account or access to Bodywork.Exchange at any time, with or without notice, if we believe you have violated these Terms, created risk for the community, provided false information, misused the site, violated the law, or acted inconsistently with the purpose of Bodywork.Exchange.

You may stop using the site at any time. You may request account deletion by contacting us at massageclub@bodywork.exchange.

Some information may be retained after account deletion as reasonably necessary for backups, legal compliance, safety, fraud prevention, dispute handling, payment records, moderation records, or enforcement of these Terms.

24. Disclaimer of Warranties

Bodywork.Exchange is provided “as is” and “as available.”

To the maximum extent permitted by law, Bodywork.Exchange disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, safety, quality, and suitability.

We do not warrant that:

• The site will be secure, uninterrupted, error-free, or available at all times.
• Profiles, photos, messages, or member information are accurate or truthful.
• Members are safe, honest, trained, licensed, insured, healthy, or suitable.
• Any meeting, exchange, trade, massage, bodywork session, communication, or relationship will be safe, successful, legal, or satisfactory.
• Any content or service will meet your expectations.

You use Bodywork.Exchange at your own risk.

25. Limitation of Liability

To the maximum extent permitted by law, Bodywork.Exchange, its owner, operators, affiliates, contractors, service providers, licensors, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or other damages arising from or related to your use of the site.

This includes damages related to:

• Online or offline interactions with members.
• In-person meetings.
• Massage, bodywork, touch, practice, trades, professional services, or paid services.
• Member conduct.
• Content posted by users.
• False, misleading, offensive, harmful, or illegal content.
• Account suspension or deletion.
• Lost messages, lost data, or deleted content.
• Site downtime or technical errors.
• Unauthorized access, security incidents, or third-party services.
• Personal injury, emotional distress, financial loss, reputational harm, or other harm connected to member interactions.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to Bodywork.Exchange or these Terms will not exceed the amount you paid to Bodywork.Exchange in the twelve months before the claim, or $100, whichever is greater.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the maximum extent permitted by law.

26. Indemnification

You agree to defend, indemnify, and hold harmless Bodywork.Exchange, its owner, operators, affiliates, contractors, service providers, licensors, and representatives from any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorney’s fees, arising from or related to:

• Your use of Bodywork.Exchange.
• Your content.
• Your messages.
• Your interactions with other members.
• Your offline meetings.
• Your massage, bodywork, touch, practice, trades, paid services, or professional services.
• Your violation of these Terms or Community Standards.
• Your violation of law.
• Your violation of another person’s rights.
• Your misrepresentation, misconduct, negligence, or wrongful acts.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us.

27. Legal Compliance and Law Enforcement

You agree to comply with all applicable laws and regulations.

We may disclose information, preserve records, restrict accounts, remove content, or cooperate with law enforcement, courts, government agencies, payment processors, hosting providers, or other parties when we believe it is required or appropriate to:

• Comply with law or legal process.
• Protect Bodywork.Exchange.
• Protect members or the public.
• Investigate fraud, abuse, threats, safety issues, or illegal activity.
• Enforce these Terms.
• Respond to reports involving minors, exploitation, threats, violence, harassment, scams, or other serious misconduct.

28. Changes to These Terms

We may update these Terms from time to time. When we do, we may post the updated Terms on the site, update the effective date, or provide notice in another reasonable way.

Your continued use of Bodywork.Exchange after changes become effective means you accept the updated Terms. If you do not agree, stop using the site.

29. Governing Law and Venue

These Terms and any dispute related to Bodywork.Exchange will be governed by the laws of the State of California, without regard to conflict-of-law rules, unless applicable law requires otherwise.

Unless applicable law requires otherwise, any legal action related to these Terms or Bodywork.Exchange will be brought in the state or federal courts located in San Francisco County, California, and you consent to the jurisdiction and venue of those courts.

30. Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect. The invalid or unenforceable part will be interpreted as closely as possible to the original intent while remaining lawful and enforceable.

31. Entire Agreement

These Terms, together with the Privacy Policy, Community Standards, Safety Guidelines, and any posted rules or payment terms, form the entire agreement between you and Bodywork.Exchange regarding your use of the site.
